How Does Illinois Define Birth Injury?
In the State of Illinois, birth injuries are a form of medical malpractice that causes harm to a baby or its mother during birth. This could include, but is not limited to, failing to diagnose a condition, failing to provide adequate follow-up care, making surgical errors, or improperly administering medication.

How Long Do I Have to File an Illinois Birth Injury Claim?
In the State of Illinois, you have eight years to file a birth injury claim from the date of the incident (so long as the victim is a minor.) However, there are exceptions, such as if the child becomes disabled; in this case, you may file a claim until the child is 22 years old, since the disability may not manifest fully until adulthood.
Keep in mind that even though birth injuries are considered a type of medical malpractice, which normally carries a two-year statute of limitations, Illinois makes major exceptions in birth injuries. For instance, if it’s found that a care provider fraudulently withheld information to hide mistakes on their part, the statute of limitations increases to five years.
